Birdsong Terms of Service

1. What Birdsong is
These are the terms of service for Birdsong, a product of Birdcage Group Pty Ltd, an Australian company. They apply to the Birdsong application at birdsongapp.io and app.birdsongapp.io, and to the Birdsong companion app installed to a phone. Where these terms say “we” or “us”, it means Birdcage Group Pty Ltd as the operator of Birdsong.
Birdsong is business growth software built and run by Birdcage Group for local Australian businesses: a leads and customer record, bookings and quotes, marketing content drafts, an ad campaign planner, an AI coach, and a check on how visible your business is in AI answer engines. It is still being actively built, so what is included can change over time.
By creating a Birdsong account, you agree to these terms and to the Privacy Policy.
2. Your account
You sign in with an email and password, or a magic link. You can belong to more than one business, and more than one person can belong to the same business. Keep your account accurate and your credentials to yourself, and tell us if you think someone else has access to it.
3. Fees
Birdsong is a paid subscription. There is no free tier. Without an active subscription for a business you can still sign in, finish setting up, and open Settings, but the rest of the app is locked until you subscribe.
The price.We do not print a price in these terms, because prices change and a number left behind here would be worse than none. What we commit to is this: the price you will be charged is shown to you before you agree to it, on the subscribe screen and again on Stripe’s checkout page. Subscriptions are per business, so two businesses on Birdsong is two subscriptions.
Renewals and cancelling.A subscription renews automatically until you cancel it, and while it is running Settings shows the date it next renews. To cancel, open Settings and choose Manage billing, which takes you to Stripe’s billing portal. You can also close your account, which is section 9.
When a subscription ends. Access to the app ends with it, and the app locks the same way it does before you first subscribe. Your data is not deleted. You keep your login, Settings, and the download of everything Birdsong holds for your business, and you can subscribe again and pick up where you left off. Closing your account is the only thing that deletes anything.
Accounts Birdcage manages. Some businesses are run for them by Birdcage and are invoiced separately, outside the app. Those accounts show as Managed in Settings and are never charged a subscription here.
Bought separately. Two things are still one-off purchases rather than part of the subscription: buying AI coaching credits, and booking a coach through Birdsong. The price is shown to you before you pay.
The fee on payments you collect. If you connect your own Stripe account and take payments from your customers through Birdsong, Birdsong charges a service fee on each payment, on top of Stripe’s own processing fee. It has a minimum and a cap per payment, and nothing is charged on a payment you do not take through Birdsong. The rate, the minimum and the cap are set out on the pricing page.
How billing works. Stripe handles it. Your card details go to Stripe directly and Birdsong never sees or stores your card number, only that a payment was made and for how much.
4. Your data, and your customers’ data
You own the business and customer data you put into Birdsong: your business details, and the leads, customers, bookings and quotes you record. The Privacy Policy explains how we hold and use it. Because some of that data is about your own customers, you are responsible for having the right to collect and hold it, and for using it lawfully. Birdsong stores and processes it on your instructions; it does not decide how or from whom you collect it.
5. Acceptable use
You agree not to:
- use Birdsong for anything unlawful, or to harass or spam people;
- upload or add personal information you do not have the right to hold;
- try to access another business’s data, or work around the access controls that keep businesses separate;
- try to break, overload, or reverse engineer the service.
We can suspend or close an account that does any of this.
6. AI-generated output
Birdsong uses AI, including Anthropic’s Claude, and in the AI-visibility check, also OpenAI’s ChatGPT and Google’s Gemini, to draft things for you: marketing strategy, content ideas, ad campaign copy and targeting, the wording of a quote, blog and email drafts, and coaching replies.
Every one of these is a draft. It has not been checked for accuracy, for compliance with advertising or consumer law, or for whether it is right for your business or your customer. You are responsible for reading it, editing it, and deciding whether to use it, including before you publish it, send it to a customer, or price a job from it.
Birdsong does not guarantee any result from using generated content, running a campaign built from it, or acting on a quote it drafted: not a lead, not a booking, not a sale, and not a particular AI-visibility score. The AI-visibility check describes what a small number of AI engines said on the day you ran it. It can change without you changing anything, and it is not a promise about how your business will be found in future.
7. Third-party connections
If you connect Google, Meta, TikTok, or your own Stripe account, you are granting Birdsong the access described in the Privacy Policy. You can disconnect at any time from Connections, and disconnecting also deletes the performance figures Birdsong collected from that account. Birdsong is not responsible for those providers’ own services, including outages or changes on their end.
Conversion tracking.If you switch on conversion tracking, Birdsong sends your completed sales to your own advertising account, including an irreversible SHA-256 fingerprint of the customer’s email and phone. Section 6a of the Privacy Policy sets out exactly what is sent. This is your customer’s information going to a platform you control, so by switching it on you confirm that you have told your customers you share data with advertising platforms for measurement, that you have a lawful basis for doing so, and that you will honour any request from them to stop. Birdsong acts on your instruction here and does not decide what you may lawfully share. If you are not sure, leave it off.
8. Liability
To the extent the law allows, Birdsong (Birdcage Group) is not liable for indirect or consequential loss arising from your use of the service, and our total liability for a claim is limited to the amount you have paid Birdsong in the 12 months before it arose. Nothing in these terms excludes a guarantee or right you have under the Australian Consumer Law that cannot be excluded by agreement.
9. Ending this agreement
You can close your account at any time from Settings. If you are the sole owner of a business, this permanently deletes that business and everything in it (leads, customers, bookings and quotes) and cannot be undone. If someone else also works in a business you own, you will need to remove them first: there is no way yet to hand a business to someone else, so we will not delete it out from under them.
We can suspend or close your account for a serious or repeated breach of these terms, and we will tell you why where we reasonably can.
10. Changes
Birdsong is under active development, so this service and these terms will change. We will update the date at the top when they do. Continuing to use Birdsong after a change means you accept the update.
